No one thinks that they are getting married more than once. They think once they walk down the aisle, they are going to be with that person for the rest of their lives. This is the point of marriage, but for many people, it simply doesn’t work out that way. Some reasons for divorce are obvious, and others are a bit more complicated. Sometimes, those in a troubled union will try separation agreements before they give up on the marriage completely. Other times, this is just the first step towards the inevitable.

Whether you are putting together separation agreements for the sake of trying to spend some time apart to save the marriage, or doing it as a step towards divorce, you have to do it right. In some states, you have to have fault in a marriage, or you have to be separated for a certain amount of time to get no fault divorce. Either way, properly filled out paperwork is going to make everything easier on everyone, and that goes double if you have children. In many cases, you can do these on your own by getting the right paperwork, but you do have to be careful when you do so.

You can get lawyers to do separation agreements if you are sure you can not handle the terms on your own. There are many things you have to include and a lawyer should know everything. These separation agreements can include things like who will live in the home and pay the mortgage, how the bills are to be paid, and what to do about maintenance. These are normally things married couples do together, but if they are living apart, these things need to be decided to avoid conflict, especially if trying to heal the union.

When it comes to children, everything about their care needs to be spelled out by separation agreements. This means visitation and anything else that might be relevant to their care. This might mean a lawyer is necessary. Neither of the parents want the children to suffer because things are not working out very well. Having everything in writing, and following through on those things, can help if a divorce is necessary, and might set the terms for a peaceful final separation rather than a war in the courtroom. You may even find that a good, solid separation agreement will pave the way for a way to work things out in the marriage after all.
